Terms of Service

1. Acceptance of Terms
By installing, accessing, or using Vensa (“the App,” “Service”), you (“Merchant,” “you”) agree to be bound by these Terms of Service. If you do not agree to these terms, do not install or use the App.
2. Description of Service
Vensa is an AI-powered virtual try-on solution for e-commerce stores. The Service allows your customers to upload photos and see how your products look on them using artificial intelligence image generation. Vensa is available as:
- Shopify App — installed via the Shopify App Store
- WordPress/WooCommerce Plugin — installed via plugin upload and activated with a license key
- Magento Extension — installed via Composer and activated with a license key
3. Eligibility
To use Vensa, you must:
- Be at least 18 years of age
- Have the legal authority to bind your business or organization to these terms
- Have an active e-commerce store on one of our supported platforms (Shopify, WordPress/WooCommerce, or Magento)
- Comply with the terms of service and acceptable use policies of your respective platform
4. Account and Usage
4.1 Account Registration
You are responsible for maintaining the security of your account credentials, license keys, and API access tokens. You must provide accurate information and keep it up to date. One person or legal entity may not maintain more than one Vensa account.
4.2 Usage Limits
Your usage is subject to the limits of your chosen plan. Current plan limits are:
Shopify (effective early August 2026):
- Free: 10 try-ons per month
- Starter: 100 try-ons per month, then $0.15 per additional try-on up to $30 per billing cycle
- Growth: 250 try-ons per month, then $0.12 per additional try-on up to $50 per billing cycle
- Pro: 1,000 try-ons per month, then $0.10 per additional try-on up to $50 per billing cycle
Additional try-ons are only available on paid plans. The spending cap per billing cycle can be raised or lowered by you at any time from the Billing & Plans page in your Shopify admin, and once the cap is reached the try-on widget is disabled until the next billing cycle. Usage is also subject to fair-use limits to prevent abuse. Until these plans take effect, Shopify merchants continue on their existing monthly limit at no charge.
WordPress:
- Free: 50 try-ons per month
- Pro: 500 try-ons per month
- Agency: 2,000 try-ons per month
Magento:
- Pro: 500 try-ons per month
- Enterprise: 2,000 try-ons per month
When your monthly quota is exhausted, the try-on widget will be temporarily disabled until the next billing cycle.
4.3 Fair Use
Individual customers on your store are limited to 10 try-ons per week to prevent abuse. You may not use the Service to circumvent these limits through automated means, bots, or scripts.
5. Billing and Payments
- Shopify: A Free plan is always available at no charge. Paid plans take effect in early August 2026 and are billed monthly through Shopify's billing system, so charges appear on your regular Shopify invoice. Additional try-on charges beyond your included quota are billed as usage charges, capped per billing cycle as described in section 4.2. Subscribing to a paid plan requires your explicit approval in the Shopify admin, and raising your usage cap requires a further approval.
- WordPress & Magento: Licenses are billed annually via PayPal. All paid plans come with a 30-day money-back guarantee. Refund requests after 30 days are handled on a case-by-case basis.
- You may upgrade, downgrade, or cancel your plan at any time.
- Shopify: cancelling a paid plan is prorated. You are refunded for the unused remainder of the current billing period through Shopify, and your store moves back to the Free plan.
- WordPress & Magento: cancellations take effect at the end of the current license period. No prorated refunds are provided for the remaining period beyond the 30-day money-back guarantee.
6. License Terms
For WordPress and Magento merchants:
- License keys are non-transferable and may only be used on the number of sites specified by your plan
- Sharing, reselling, or publicly distributing license keys is strictly prohibited and may result in immediate revocation without refund
- Upon license expiration, your plugin/extension will continue to function but you will not receive updates or support. Try-on functionality depends on your remaining quota.
- You may renew an expired license at any time to restore full access to updates, support, and quota
7. Merchant Responsibilities
As a merchant using Vensa, you agree to:
- Inform your customers that AI virtual try-on is available and how their photos will be used
- Include appropriate privacy disclosures in your store's privacy policy regarding the use of Vensa and customer photo processing
- Not use the Service for illegal, harmful, or fraudulent purposes
- Ensure your product images meet our guidelines for optimal AI results
- Not attempt to reverse-engineer, decompile, or extract the source code of the App
- Not resell, sublicense, or redistribute the Service or any part thereof
8. Intellectual Property
- The App, including its code, design, documentation, and branding, is the intellectual property of Vensa
- Your product images and brand assets remain your property
- AI-generated try-on result images may be used by you and your customers freely
- We do not claim ownership of any customer-uploaded photos or AI-generated results
9. Disclaimers
- The Service is provided “as is” and “as available” without warranties of any kind, express or implied
- AI-generated images are visual approximations and may not perfectly represent actual product fit, color, or appearance
- We do not guarantee any specific conversion rate improvement or business outcome
- We are not responsible for customer purchase decisions based on try-on results
- Service availability may be affected by third-party dependencies (Google AI, Cloudflare, Shopify, PayPal)
10. Limitation of Liability
To the maximum extent permitted by law, Vensa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total aggregate liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Vensa, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any claims by your customers related to the try-on feature on your store
12. Termination
- Shopify: You may terminate by uninstalling the App from your Shopify store at any time
- WordPress/Magento: You may terminate by deactivating and removing the plugin/extension from your site
- We may suspend or terminate your access immediately if you violate these Terms
- Upon termination, your data will be retained for 90 days to allow for reinstallation, after which it may be permanently deleted
- Sections regarding limitation of liability, indemnification, intellectual property, and governing law survive termination
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the App dashboard at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from or related to these Terms or the Service shall be resolved through good faith negotiation first. If a resolution cannot be reached through negotiation, the dispute shall be settled through binding arbitration.
